1. Scope of Civil Engineering & Site Development Services
Apex Site Service provides comprehensive heavy civil contracting, complete raw land site development, structural and selective interior demolition, baseline utility installation (water, sewer, and electrical systems), grading, and structural stormwater management infrastructure.
- Bidding & Estimating Architecture: Project proposals, commercial contract bids, and estimated construction timelines provided via 571-572-5169 or http://apexsiteservice.com/ are conditional and preliminary. Final binding agreements are executed strictly in writing based on physical site evaluations, structural engineering blue-line reviews, zoning authorizations, and certified geotechnical subsurface analysis profiles.
- Subsurface & Subterranean Geotechnical Realities: Due to the heavy mechanical layout of deep excavation, utility pipeline trenching, and foundation preparation, all contract execution is subject to subterranean conditions. Apex Site Service reserves the absolute right to issue a formal contract Change Order if unmapped subterranean rock formations, high water tables, shifting soil compositions, or unmapped private utility assets alter the safety or structural feasibility of the excavation blueprint.
- Demolition Conditions: Demolition and removal services rely entirely on architectural prints and structural declarations provided by the property owner or project manager. The client assumes absolute liability for verifying that all structures slated for removal are free of structural encumbrances and completely cleared of hazardous materials (such as asbestos or lead) unless hazardous remediation is explicitly incorporated into our written contract scope.

5. Private Utility Clearing & Substrate Damage Disclaimers

However, the client, developer, or primary property manager assumes absolute liability for mapping, locating, and visually marking all private, unmapped secondary lines (including secondary irrigation, detached electrical lines, private water loops, or private data lines). Apex Site Service disclaims liability for strikes or accidental disruptions to private utility structures not explicitly and accurately marked on the provided engineering plot plans.
6. Limitation of Liability
To the maximum extent permitted by Virginia statutory provisions, the aggregate civil liability of Apex Site Service for any construction variance, structural omission, or contractual dispute shall not exceed the actual aggregate financial sums paid by the client under the specific project contract. We assume no civil liability for pre-existing environmental soil conditions, toxic mold development, or foundation cracking within surrounding permanent structures that occurred prior to our mobilization.
